What is the name of your state?Florida
My mom passed away last year. She was survived by her second husband. There was a will which we just discovered last week and names me (her son)beneficiary of an estate with cash value of $30,000. There is no P.O.D. on this cash account presently being held in a bank savings account.
The surviving spouse will be remarrying in about a month. My question is:
Does the surviving spouse lose his right to an elective share of the estate once he remarries? Thanks for any help.

if probate on a small estate is opened after the surviving spouse dies, does his estate have a claim on the estate of his spouse whom he outlived?

Who are you to "dupe" the surviving spouse out of his elective share? Do the right thing and open probate.
