Hi, any help would be appreciated. We've read a lot saying that I'm probably okay but of course there are always conflicting stories.
My wife and I live in California. Going into the marriage (1 year ago) we each had separate properties, mine in California and she had a rental in Las Vegas. Well, we decided to short sale the Las Vegas home because it's completely underwater. We do have a short sale offer, but bank isn't moving. We might stop paying mortgage and see if it speeds things up.
If she ends up foreclosing, can the banks come after my assets? California and Nevada are both common law states, but she has no ties to my property, I refinanced last year and quit deed'ed her off so the title stayed with my name only. I should have no ties to her property.
Thanks in advance. What is the name of your state (only U.S. law)?
