What is the name of your state (only U.S. law)? TN

If there is a tv show showing a minor having sex but it is censored and it is still illegal and the DA is not pressing charges, can a good citizen take the prodercs or someone to court seems how it is affecting our children etc.?

You can write a letter to the sponsors and tell them that you are voting with your dollars.

That is the most you can do.

Unless you can show ... not just suspect, but show... that you have been personally or those under your direct care have been personally impacted, you are not the victim.

You cannot sue for what might or could happen.

what if the minor had sex without a condom, and as a result of that a person thought it was ok to have sex without a condom and something happened

That would be akin to me seeing a murder and committing one and then blaming the television show for showing me the fictionalized murder.

You are trying to find a way to turn an opportunity to talk with your child about bad choices (which should be the result of seeing bad behavior on television) into a lawsuit where you or your child is the victim.

You cannot. It will never reach court.

its on cable and the fcc does not regulate cable. In one case i know of a parent let their child smoke weed and smoked with them and there is proof of this.Dcs investigted 3 times and did not take appropriate measures to ensure the childs saftey.Someone told me I cannot take dcs to court because of lack of standing.Someone else told me that I can have the judge appoint me official standing. How does this work, official standing and how does this relate to what is happening here with the child porn? Can I have a judge appoint me official standing seems how the parents are the ones that put him on camera and he doesnt even know about it, can I help the child?

Who are you to the child?

what kind of shows are you watching? This is surely not on a public access (non-pay) site.

Child porn is illegal whether it is censored or not so I have to really wonder what you are watching.

Im just trying to get the show off the air, not make money

I thought you were trying to save a child?

Let me say again... a judge will consider a parent's day to day influence much more significant to a child's development than any television program.

Further, you are not a party to any damages. You cannot sue on the basis of moral indignation.

I am just a concerned citizen. On yahoo answers about the DCS case someone said.

If you have no standing, you would have to go to court and have the court declare you a friend of the court or provide you official standing before you'd be in a position to insist that officials act.

Then I talked to an attourney who said

Only in VERY rare cases, where a case directly impacts on other people, will a court allow a case to proceed where there is no "actual controversy in law", and where no-one with standing has brought an action.

An example of a case that was never heard because the courts ruled that *no-one* had standing to file it would be the "birther" challenges to Obama's right to be elected President. The cases were all dismissed without being heard on the merits, because in each case the judges ruled that (To quote one of a number of similar rulings) "The potential damages to any one specific citizen from an unqualified individual being elected President are so remote and tenuous that they do not rise to a level sufficient to grant that citizen standing before this court"

====
So here are my questions.
Can I takeDCS to administrative court for parents allowing their child to be filmed in the nude performing sexual acts?DCS does nothing about this

the attourney said
The potential damages to any one specific citizen from an unqualified individual being elected President are so remote and tenuous that they do not rise to a level sufficient to grant that citizen standing before this court

So does this mean if it is affecting enough people it would be possible?

He also said

How do I go about getting this to happen?

Okay, you are not listening.

YOU HAVE NO CASE.

Contact the supervisory head of the DCS about your concerns.

Your options stop there.

no

this is a criminal matter. Call the local police. If they fail to act, call the state police. If they fail to act, if this program?? is broadcast outside of the state, contact the FBI.
