Recently acquired a rental property that has been in the family for some time. I helped my parents manage it before they passed, but my brother has been managing it as a trustee for the past 8 years. One tenant has been there almost 20 years and is quite difficult, then and now.
Since I purchased it in January, he has been paying towards the end of the month, has a dog (which I saw) and when asked, denied it, won't let the exterminator in, even with prior notice (the problem originates from his apt, and affects others). I tried to give him a yearly lease using a program that has an electronic portal but he claims he doesn't know how to access it (although he uses social media just fine). The program doesn't allow the lease to be signed (electronically) by the landlord until the tenants sign and since he hasn't even logged in, there is no executed lease. I did issue rent increase notices in January and that is the amount he is paying, which was reflected in the lease he did not sign, I consider him month-to-month and the apt is not rent-controlled.
I had a conversation with him over the weekend and told him that the rent needs to be paid by the 5th of each month, but he said he gets his disability check after the 10th, and it's too bad, he won't have it until then. He also told me that my brother tried to get him out and they came close to a fistfight over it. He said good luck getting rid of him as he is over 60 and on disability, and it will take at least a year to get rid of him. He also said that his check won't cover any future increases (my brother under-rented the apts) and he simply won't pay.
I would like to see him leave at some point, and plan to speak with an attorney soon. Trying to determine if there is a possibility to tell him, as a month-to-month tenant, he as 30/60 or 90 days to leave, increase rent more frequently or go through an eviction process. In advance of going though this process, has anyone tried to evict a tenant on disability, and did it actually take a year.
