Social Security

I am not a lawyer, however, I do believe that under ERISA,
Ex spouses Retirement Income Security Act, as you have been married at least 10 yrs., you will be entitled to an amount equal to half his entitlement - provided you don't remarry before age 60 in which case the soc. sec. is based on your new spouse unless you divorce. Your ex-spouses soc. sec. entitlement will not be affected at all when you claim soc. security under ERISA. Please talk with a lawyer or social security. Hope this helps!
