What is the name of your state (only U.S. law)? Child custody case in Arizona, My child and I live in Ohio

This may be a little complex for a forum but if anyone has any input, advice I’d appreciate it

History

Had a child without being married in ’97. When I decided to move to Ohio in 2006 the father decided to file for custody/paternity. Judge ruled ok for me to move with child to Ohio, dad had no visitation and would get supervised once he completed drug testing and psychiatric evaluation. Child support order also entered and he was also to pay 3 years back support.

Father did not complete any court ordered testing and has never paid any of his child support.
Child has not spoken to or seen father since 2007.

I married and have been married for almost 5 years. I would like to terminate bio-dad’s parental rights and have my husband adopt my child for two reasons, I would like her to have a legal father that has actually been the only father she has known and if something were to happen to me I would hate for her to have to go to her bio-dad.

I do not know his current residence, and he has not up-dated the court with that info either. We do have contact with his family that is in Ohio and they speak to him from time to time when they can find him, but they have no idea where he is.

I am not sure what the obstacles would be living in Ohio with case in Arizona or if I can file in Ohio, have case moved, ect. and what the likely outcome would be should I pursue this.

Any help, input is appreciated! Thank you!

You will want to work with an attorney who is familiar with step-parent adoptions. Why you are attempting to do IS possible, but with inter-state matters such as this, it's probably too complex to do alone.

This would be an Ohio adoption case. Dad would need to be served but his permission would NOT be necessary for your husband to adopt. Contact an Ohio attorney for the adoption.
