I am a mother of two. I was recently married and my husband supports both of my children. He is going to adopt my 3year old son. There should be no problem because his natural father is deceased. I also have a 1 year old daughter from a previous relationship. I was never married to her natural father but his name is on the birth certificate. He will not give his consent for the adoption. There is no court ordered child support and he has paid $200.00 in 10 months. His last visitation with his daughter was December 2000. I also gave him visitation to my son because of a relationship he had formed with him while living with me. When the children were returned from this visitation there were severe bruises on my son. He is now undergoing charges of child abuse. During his interview with the investegators he admitted to the abuse. His reasoning was because my son went to the bathroom in his pants. I'm not sure what the severity of this case is according to the state. I do know that it is a 3rd degree fealony and a 6th degree child abuse case. He has not had visitation with his daughter since the incident because I do not believe it is in her best interest. My question is in Florida Courts do I have any chance of proving him as an unfit father because of this incident. There was no harm done to my daughter (his biological child) The abuse was done to my son (not his biological child).Because of the fact the abuse was not on the child in question I'm not sure if I'll have a chance of proving him unfit so my husband can adopt her.
