What is the name of your state (only U.S. law)? Ak

The adoption is on Friday.

My ex signed away his rights through the required paperwork. It's notarized, all in order and has all been reviewed. We are just waiting for the hearing.

My ex lives in a different state.

Is he required to attend the hearing telephonically?
Or
Since he has signed the paperwork has he done his part?

I need to know if I should remind him of the date and time as he is a total flake. I worry that in doing so, as he is having a rough week he may flip flop and change his mind even though he says he is 100% sure he wants this.

Help!

This is a question you should be asking your lawyer. You should most definitely not be attempting a step parent adoption without a lawyer.

LOL!

Do you offer advice or just tell people to ask a lawyer? I certainly could ask a lawyer, buti came to FREE advice rather.

We are not using a lawyer BECAUSE my lawyer said our case was straightforward and did not require any legal assistance.

So rather than pay a few hundred bUcks to ask him a question that is simply to allay my fears I'd thought I might ask here

Umm,
I'm pretty certain that responding with a pompous
"go ask a lawyer" was fairly rude.

No where did I ask if I needed one Or did I request that people avoid my question and chastise me for not having one in this situation.

I'm pretty certain, in fact, that when the only response I received was this get a lawyer rhetoric that I already was on my own.

However, if there is someone out there who actually knows the answer to my question, it probably would be helpful to me and others who have the same query.

If no one on this pseudo legal advice site actually understands or has knowledge that is relevant to the matter, come Friday I will follow up with an actual answer.

But until then, I would still really love an actual thought out response.

I think the question is fairly simple. I also think that if you all followed your own advice on asking lawyers every little thing that does not actually require a lawyers time to handle you would be extremely broke.

Well... sweetpea... Do you realize that it is SATURDAY? That people on here (i.e. VOLUNTEERS) may have families that they are spending time with? Which means that they are not sitting at their keyboards, just waiting to answer questions that people may have? So when you don't get more than one response within roughly an hour, and then you get snotty with the one person who did have an opportunity to reply, the rest of us take one look and move on along? YOU are asking US for a favor. And when you give one of us lip? The rest of us aren't interested in helping you.

I don't think many here will tell you anything other than that you should speak with your attorney. Adopting a child is serious business. It is NOT something to play around with. But you go ahead and pretend it is. <spit>

This is a public forum. There are probably people on here who have experienced an actual adoption and may know who is required to attend

Also, this is FREEadvice.com
Not gopayalawyer.com

Further, seeing as you so kindly pointed out, it is SATURDAY. Lawyers are not volunteers. They work Monday-Friday.

I wasn't expecting to receive an accurate response for perhaps a few days. But the people who have responded on here and seem to have no knowledge considering matters on adoption actually according to their posts an profiles do indeed sit here trolling. All day. Everyday.

I was hoping to eventually get one of the junior posters comments, because they actually seem to offer more input and have experience with real life beyond being the head trolls on gopayalawyerbecause iknownothing.com

Go pay a lawyer, cupcake. Because no one here is interested in helping a wise donkey. Bye-bye.

The answer

For anyone who has this same question there are sites out there will people will help you!

A. In step parent adoptions the consenting parent whos rights are to be terminated must sign and have notarized all of the paperwork provided by the court. The court provides ALL needed documents. Once the paperwork has been turned in and approved, a hearing days will only be set if the documention is complete. The consenting parent them has 14 days to renig their termination of rights. Following the 14 day period, the parents rights are considered TERMINATED.

The court only has to finalize the proceedings and legalize the adoption. Both parties may attend, but this is not a typical occurrence. As parental rights have been terminated, this parent is NOT required to attend. Families usually bring their children and the hearing is typically conducted in the judges chambers for intimacy rather than in the courtroom.

There are many sites out there with people who will actually help you instead of telling you to pay hundreds to thousands of dollars for simple matters! I was so glad to have turned to a different site and to get immediate responses from others who have been in my situation.

And OP, you are 100% confident that your answer holds true for every state (not just Alaska)? Please provide proof.

Got my info from a gal on a forum for step parents who does indeed live in Alaska. Info was further supported by others from various states. All in all for about a total of 13 congruent responses.

I will not be linking you to my forum, sorry. I have posted on here before under a different username and had my Facebook info and other personal info displayed.
