My husband has full custody and I would like to adopt my step son. He is 5 and I have been in his life for 2 years. We have a very close relationship and he calls me mommy. I have known my husband for 14 years and have known my step son his whole life.
His biological mother has not had anything to do with him for the past three years. She never filed for visitation with her son. In 3 years she called him once, last year. She has not paid support in 10 months and before that would only pay here and there. She's behind a considerable amount. In the past 3 years she has not called my step son for any holidays or birthdays nor has she sent him any cards or gifts for any occasion. There has been no contact other than a token visit in March 2012.
The mother has a felony for beating my step daughter. (Step daughter was 5 and step son was 2 months old)She still owes fines for those charges and can still be prosecuted because of that. Because of the felony court papers say that the mother cannot have contact with my step son unless my husband supervises. Also, the mother is engaged to a married, registered sex offender and they just had a baby together.
The mother has never helped with any school fees or anything pertaining to preschool or kindergarten.
My step son has no form of relationship with his mother. He calls her by her name whenever she is spoken about and has no clue who she really is.
I believe we can show abandonment, neglect and that we can prove the mother unfit. According to the state of Tennessee, what are my chances of being able to adopt my step son?
