My response:
More than probably not. What your Mom didn't know or understand is that when a person, such as herself dies, the value of their case virtually dies with them; i.e., When a person who is in litigation dies, "pain and suffering" damages dies right along with them. In most cases, pain and suffering damages is the largest portion of a person's lawsuit.
However, he may have also been a plaintiff against the doctor for his "loss of consortium". In that instance, that's HIS cause of action, and any money received from that portion of the case is entirely his.
So, if your step-dad continued the case on behalf of your Mom's estate, he continued it to obtain "pecuniary" damages - - a small amount by comparison.
So, the money had to have come from some other source like a hefty life insurance policy. If that's the case, you wouldn't be entitled to that insurance money anyway.
Unless you know the name of the case, and in which county of California it was filed, it's doubtful you find any information about it.
