My husband's ex-wife was recently killed in an automobile accident. I have been in his sons life for 5 years. He is 7 now. I want to adopt him but have heard that some states require that the grandparents be notified and given an opportunity to establish visitation. We do not keep him from his grandparents but do not wish to have another court order hanging over our heads. Does Idaho law require that the mother's parents be notified? And if so, is there a way to stiputlate open visitation rather then a specified "every other weekend" arrangement. Also if they are eligable for visitation is there usually a standard a judge would allow them? Also am looking for a lawyer to handle this for a reasonable fee and payments. Do not see anything that can't be mediated with the grandparents. Also am living in Oregon currently. How long to we need to live in Idaho before filing and if we have to wait can we file in Oregon while living in Idaho?

I don't beleive that the "family" of the Mother needs to be contacted of the adoption. The only way that grandparents can "fight" for visitation rights, is if they go to court and in order to go to court and have a case; they need to have been denied contact with the children for some time. Since you allow the grandparents contact with the childre, there is no reason that the grandparents should take you to court for anything.

So, if you, your hubby and the child are in aggreeance to the adoption; adopt the child and be the best Mother you can.

Good luck!

(Someone will correct me if I'm wrong.)
