Stepparent adoption when bio-father is unknown.

Florida. My husband is wanting to adopt my 5yr old son. My ex-husband's name was put on the birth certificate since my son was born while we were married. However, in our dissolution of marriage he was established as not the bio-dad and we asked for his rights to be terminated. It was granted. We also had a child support hearing the Department of Revenue asked for and once again my ex was deemed not the bio-dad and his rights remained terminated. The biological father is unknown and has never been in the picture. How do we go about this perdicament?What is the name of your state (only U.S. law)?

Maybe it was a very dark room?

Could be. But still... mom is going to have to NAME the POTENTIAL fathers if she wants a stepparent adoption. The father being unknown does not mean one has not been established. Unless mom can PROVE this was a case of RAPE by a stranger she is going to have issues. The potential father(s) wilL HAVE to be served and John Doe posting will have to be done.

To be fair... Mom may have been raped by a stranger. But... I'da thunk she'd have mentioned that.

Actually it isn't anybodies business why the biological donor to my son is not known. The fact is that he's not and according to the courts it's just fine. I've filed all the necessary paperwork, we've had the search of the Putative Fathers Registry done in which no man was established to have named either myself or my son in the registry, therefore, my son is eligible for adoption.

I dont mind the low blows at me but this is "Free Advise.com" not "Let's Make Ourselves Feel Good By Making Fun Of Others.com"
