What is the name of your state?Nebraska

My husband is supposed to pay back the state for the birth of his daughter in 1993. His ex at the time was on welfare and put the birth under medicare although my husband had adequate insurance. by signing the paternity papers he also was obligated to pay back the state for the birth under the assumption that he would marry his ex and they would pay it back together that never happened and now he is stuck with bill and his ex pays nothing is there anything he can do to possibly have the amount shared between both parents which we'd be more than willing to do? Anyone with a similar experience?

Was he married to this woman when the child was born? Probably not or his insurance would have paid. Was he financially able to help this woman at the time of the birth....did he offer financial help or did he leave her own her on for the state to deal with.

Situations like this are complicated. You need to include a little more detail about exactly what happened. I can tell you this though. If she became pregnant during a time that she did not have the financial resources to pay the medical bills then she will not be held responsible for paying money back. If, on the other hand, he knew she was pregnant and had failed to offer her support with medical costs which made it necessary for her to go to the state then he will be responsible.

All ins. companies will pay for a childs hospital costs after birth once they are added to the policy, as long as it is within a certain time period following the birth. The MOTHERS hospitilization costs are a different story.***

Does your husband pay child support through the state? (he legally has too, if the mom is still on welfare or still owes the state) if so it is VERY likely the ex IS paying for it also, you see, when you go on welfare, you give up the right to income, and that includes child support.

If you receive child support, or are awarded a large sum of money, the state must get some of it back to pay your welfare debt, even if you are no longer actively receiving benefits. If your husband pays through the state, an amount of welfare owed to the state by BOTH parents is removed before the mother gets her welfare check. therefore she does not receive the full amount of support owed to her by your husband, some of it is diverted to the state towards her debt also.***
