Here are some links to a Murder trial recently started which involves many twists and turns even involving some family law shnanagins. If it were a plot for a movie or book you wouldn't believe it. The trial starts just shy of 3 years from the DOD.

It starts out in the 1950's when deceedent, 70 yo psychologist, was in the USN and hospitalized for 1 year as being psychotic, suicidal and incestuious intent for his sister. The medical records have been allowed in as evidence.

Somehow becomes a licensed psychologist.

A 14 yo girl is sent to therapy following her parents divorce. The psycho-therapist becomes sexually attracted to the 14 yo client and has sex with her in his office. This continues dispite efforts of her parents to redirect her to boys her age, the relationship continues dispite his marriage. 10 years later he divorces his wife and marries client. This breaks all the rules of therapeutic ethics and is against current CA law. They have 3 sons.

Deceedent is known as both manipulative, violent and controlling. At some point in late 1980's the issue of ritualistic child abuse arises in their family involving their then 2 yo son and his nanny and therapist/dad lectures about this. He admits to his daily anger and rage, every day of his life. The reports of RCA were deemed unfounded by the FBI nor is it the first of delusions reported by the therapist who somehow maintians a clean record with the Psych board. The therapeutic community was hot over RCA and RM issues about that time and I know of adjunct faculty members who's contracts were not renewed if they didn't agree.

After 23 years of marriage and 30+ years since her rape, the marriage fails and eventally leading to the death of the the-rapist/husband under claimed self defense. Both husband and wife are considered mentally ill, but there is no attempt at a mental health defense.

Prior to the-rapist's death he told many people including his sons that his wife was going to shoot him, not the first time he had told conviencing tales or delusions, he also claimed his wife was delusional, perhaps because of the history of his manipulative history of rape and controll with her which would threaten his license. Interestingly, his son is testifying against his mom in part, he told the police he heard shots (influence of the father?) Whereas, there was no evidence of GS, decedent was stabbed with a paring knife, by wife claiming self defense. It is alledged that dad was off his meds. Several days before this, dad had filed ex parte motion in Fam Law court to take custody of 1 minor son, reduce child support and possession of house while mom was out of state preparing to move after divorce, she was not served with notice of hearing.

If this were a math problem, how many victims?

Case gets stranger still....................

On Sat, lead Defese Attorney returned home to find his wife dead in the enterance of their temp. home. Their home, under construction, was located approximately 7 miles away, in a different town but served by the same sheriff department and investigators etc. from the home of his client. Sometime on the same day, there was a report filed with local police re attempted breakin at home of client, also being investigated. For these reasons, the judge declared a mistrial this morning and new trial set for January. An unnamed suspect was taken into custody this afternoon and there is a history of a r/o applied for June 2005, but later dropped by the court. This is being covered by national media.

Teen Arrested In Murder Case

According to Associated Press A 16-year-old boy was arrested on suspicion of murder in the slaying of Pamela Vitale, the wife of criminal defense lawyer Daniel Horowitz.

The teenager was arrested Wednesday night after search warrants were served in Lafayette, California. San Francisco newspapers have reported leaks from unnamed law enforcement personnel, although the investigation continues.

The psychologist's wife's story was on Dateline last week....very interesting.
The middle son will testify for Mom; the younger son against Mom.

Yes, both cases have made the national press. The Polk case will make for quite a psychological and forensic study. Yesterday's SF newspaper showed graphic pictures of the 16 yo suspect's yearbook pictures and the franatic transformation from mild mannered Boy Scout to Goth. THe whole thing is Bizarre and I suspect there will be more to come.

Teen suspect to be tried as adult

Yesterday, 16 yo Scott Dyleski who soon will be 17 was charged as an adult, this opens up a life sentence as a possibility as opposed to a more limited sentence in the Ca Youth Authority CYA. It is reported that the teen passed the CHSPE and no longer attended high school. Pictures in the SF Chronicle story graphically show his transformation. The link also references related articles.

Mother charged with accessory after the fact

The mother of Scott Dyleski was arrested and charged with accessary after the fact while her son was being arrigned on 1st degree murder violation of CA PC 187, as an adult, her seat, vacant in the courtroom. His defense attorney withdrew because of conflict and the judge issued a gag order and set a new date 11-9-5 for the next hearing.
 
Geesh!! This sounds like what I'm going through now without the murder though. I bet she gets off for murder and they put her in a hospital...

As an FYI to all, CA does not have a law regarding accessories "after the fact" ... the media often uses the term, but it is not quite accurate. An accessory is one who assists the suspect after the commission of a felony. An accessory "before the fact" would be a principal to the offense.

PC 32. Every person who, after a felony has been committed, harbors, conceals or aids a principal in such felony, with the intent that said principal may avoid or escape from arrest, trial, conviction or punishment, having knowledge that said principal has committed such felony or has been charged with such felony or convicted thereof, is an accessory to such felony.

Thanks for pointing that out Carl, as it turns out she was arrigned yesterday and they did a plea bargin in the courtroom in which they would release her on her OR in return for testifying against her own son. She apparently admits to some coverup, withholding/concealing evidence and aiding him in remainng away so he would not be questioned by the police. More bizarre stuff.

From what I read, it sounds like he's going down anyway. Strange kid ... apparently he started slipping only in the last couple of years, if what I read was correct.

Apparently after his half sister was killed in an auto accident he changed, however he comes from a very excentric family to start with, he was even so far out socially that the outcasts at his school thought him weird. He fits a profile for a mental disorder but none the less he is competent to stand trial.
