I am a permanent resident living in the US for the last year...my husband is not (I obtained my green card before we were married). We have two small children (one was born in the US, the other was not). My husband and child both have visitor's visas. Is it possible for them to stay in the US while I petition for both of them using the I-130?
He also would like to continue his studies by applying for a student's visa...
In view of my status would it be wise to apply for the student's visa from his home country or can it be done while he is here?

Just file an I130 and adjust his status. Best thing to do if you have the money is go see an immigration attorney.
