we recived a subpoena in the mail from third degree films and copyright defense lawyer saying that we had downloaded porn back in may. however we did not because our wifi did not have a password at that time. we are completely cluless on what to do and are we in some serous stuff?

Well you're not going to jail if that is what you are worried about. This is a civil matter. What you probably got was your ISP telling you they received a subpoena to release these records.

The "my wifi was unprotected" excuse isn't going to work. If it did then everybody would use it. The account holder is responsible for the activity on their account.

They will probably end up threatening to sue but saying you can settle and they won't. Typically around 2 - 5 k from what I've seen.
