How can I sue the Division of Aging Services? My grandmother was under a CHIP program where they provided financial assistance to house elderly in nursing homes. Under that program they are required to visit and evaluate the patient twice a month. They never did. My grandmother died from abuse and neglect in the nursing home. I filed a complaint after a visit with her and the state law says complaints must be investigated within 24 hours. They never investigated. They called me 3 weeks later (returning one of 11 messages i left during that 3 weeks period) and they told me they had just visited her that morning and my concerns were not valid she was sitting at the table eating and is being well cared for. I recieved this phone call while in the emergency room where my grandmother had just been taken by ambulance from the home. She died as a result from stage 4 bedsore infections dehydration and malnutrition.
