The are the scum bags lawyers Frederick J Hanna and Associates,
They are licensed in Georgia,
I called the Illinois Bar Association, and they confirmed they are not allowd to sue in my jurisdiction.
That is the MO. They sue people, and then when people show up, they just dismiss the case.
All they do is threaten. No, I am not being sued, yet. And based on their past history, they typically sue, so sorry for mis speaking.
I am in the process of drafting a debt validation letter, under notary protest, which requires them to send all written communication to this third party. ( I did it under the advice of an attorney)
Additionally, the attorney added all clause for all these damages.
FEE SCHEDULE
1. Mailing further notices/responses/communications to alleged debtor rather than to Notary as specified herein, $1,000 per the first occurrence, up to $5,000 per subsequent occurrence;
2. Harassing Phone calls - After proper notification, as verified by the postal return information, and without providing documentation stated above, up to $5,000 per occurrence;
3. Continuing to send alleged “Statements or Notices of Balances Due” without providing documentation stated above, up to $5,000 per occurrence;
4. Selling of the disputed “debt”, without providing proper validation, to another debt collector, up to $10,000;
5. Joinder to this action after Notary Certificate of Dishonor has been issued to a previous “alleged” collector, $50,000 per person per event; and
6. Taking any legal action you are not authorized to take (i.e. ex-parte attachments, improper process of service (notification of any pending court action) to obtain default judgments, etc, up to $250,000
I shouldn't say, my attorney, rather, he is giving free advice.
I think him not being licensed here, and representing himself as an attorney to me, would fall under point 6, taking legal action not authorized to take, like sue me!
Also, they are not licensed Collection Agency's either. I looked their first, and the IL Collection Practices Act, says attorneys are exempt.
Bottom line, they are not licensed in any way. So I want to know what is the penalty for practicing as an attorney when you are not licensed in that jurisdiction.
My gut tells me he will never go to court. Probably wants a default judgement for people who do not show up.
