I bought my home in August, 1990 from a woman and her son. We were told years later by the neighbors that the husband had commited suicide in the basement. My son has mentioned throughout the years that he always felt "his presence". I even had the home blessed. I don't believe in ghost but lately I think I am starting to feel this "presence" and it's scares me to the point I am seriously thinking of selling my home even though I like every other aspect of the home and would prefer not to move.
Questions:
Was the realtor and seller obligated to disclose this information?
If so, can I do anything about it 10 years later?
Do I have to disclose the info when I sell?

Seriously, most States do not consider a murder or suicide a material fact that requires disclosure due to the fact that the past event does not affect the physical condition of the home. So legally depending on State law, the Seller may not have had to disclose that fact, although it would have been nice to. The event has caused the property to be known as stigmatized property. There have been cases against Sellers for not disclosing such events so you should disclose the facts and presence when you sell. I always tell my clients to disclose everything even if the disclosure law does not require it. That way, as Sellers, you will be more propetec from Buyers saying, "you did not tell us so we are suing."
