What is the name of your state? Indiana

<Story about Psycho>

Thanks for confirming that I was on the right track with my motion. I'm deleting details just in case Psycho Wench finds this site, not that I think she ever would, but you never know.

I would cite all of them in the alternative.

Also (and I know you cannot answer this since you have not seen crazy's pleadings), you need to file a motion for judgment on the pleaings (or failure to state a cause of action or whatever your state calls it).

In EVERY civil case, the first thing the defendant should do (if they don't want a trial) is move to dismiss for failure to state a cause of action.

But this time, you say, "Judge, we really mean it this time."

Anyway, this nut is threatening to sue to obtain all the jewelry, since she claims that their mother promised it to her 20 years ago, just months prior to her death from cancer.
Let her sue. She has NO case. Then simply file an affirmative defense of expiration of Statute of Limitations. Each and every one has long expired.

I agree with JETX and Senior Judge. Senior Judge has given you the correct info on the papers you need to file and you need to do it very soon, even if you haven't seen the pleadings yet! And JETX is also correct, because it's been well over what any state would consider SOL in my opinion. She's wasting her money suing... and if you do get the dismissal, I'd motion the judge to order the dimwit to pay YOUR legal fees in connection with defending the action.
