Me again...

So, I have another situation that I would like your opinions on. My ex and I share joint legal and physical custody of our children. We have had them enrolled during the school year in an after school program where my EH lives and during the summer in summer camp in my area. We have shared payments of these programs per our court order which states "Each party shall pay 1/2 of childcare costs for the minor children related to employment and or reasonably necessary education or training for employment skills for the parties"

He is now stating that he isn't going to use the after school care facility and he doesn't agree with the summer program that our children have been enrolled in for the past 3 years. My question is, even though he is not using the after school care for his 3 days a week, and he doesn't agree with the summer program anymore, is he legally still obligated for paying 1/2 the costs, per our court order.

I am thinking he does still needs to pay 1/2 the costs, even though he is not "utilizing" the service, and I want to confirm that I am reading our order correctly.

Thanks

So, he should pay for 1/2 of the two days of daycare...

The summer camp is a bit more questionable...

Why would the summer camp be a bit more questionable? It's actually not a camp, per se, but more of like a YMCA or daycare type program that offers summer sessions as well.

Its not. He is required to pay half because you are using it as daycare. I live in CA also and I use the YMCA summercamp (day camp) as daycare during the summer so I can work. And yes, the judge specifically stated that it was considered day care and he was to reimburse 1/2 the cost.

That's what I thought as well

Thanks for the input. I can see he is trying to get out of paying what he is court ordered to pay by using the logic that why should he have to pay for something that he isn't using, or doesn't agree with.
