Summer Visitation Question

What is the name of your state? FL

According to the visitation arrangement, the mother is entitled to the first half of summer vacation, and I the second half.

It does not specify whether the every other weekend visits are still enforced during this time.

My question is: is she still entitled to every other weekend with the children during my half of summer?

The Father is granted the following parenting time:

1. Every other weekend from after school Friday until 5pm Sunday. If school is not in session on the Monday following the Father's weekend, he may keep the children until Monday at 5pm.

2. Summer Break: The parents shall share summer break equally. Even numbered years - the Father shall have the first half of summer break and the mother will have the second half. In odd numbered years, the mother will have the first half and the father the second half, returning the children to their mother 1 week prior to school resuming. That additional week will be counted as part of the mother's half.

Quite frankly weekends are NOT enforced during summer per your instructions. HOWEVER, you and mom should take a step back and determine if it is in the best interest of the child to go four or five weeks before seeing either one of you. The answer to that is no -- it is NOT in the best interest of the child. Would alternating weekends during the summer be that much of a problem for two ADULTS to deal with?

Not a problem at all. I was just trying to clarify. I want my children to be able to spend as much time with each parent as they wish. I don't mind keeping with the every other weekend thing, because it is beneficial to the children. I just wasn't sure, as it doesn't specify in the order and I recieved a letter from their mom demanding that during my half of summer i bring the children to her at 9am Thursday until 3pm Saturday

During her half, she wants me to pick them up at 6pm Friday and bring them back at 12:45 am on Monday. She sent a copy of this letter to the court..

We go to court regarding the custody switch on the 17th of this month, so I guess I'll just work out all the kinks with the judge. Thanks again. :)

12:45 AM??? As in forty five minutes AFTER midnight? Okay the first switch doesn't sound bad as it seems to be based on Mom's days off. But to bring kids back that EARLY in the morning? Why can't they be brought back before you go to work on Monday or mom pick them up at daycare on Monday? And what transportation does mom do? Mom is responsible or should be responsible for HALF of the transporting.
You each should also get two uninterrupted weeks to take a vacation and go out of town if you so choose. And who at the court does mom expect to read her letter?

according to the visitation judgement: The Father is responsible for all transportation of the children from the pick-up and drop-off point which is the children's school when in session or the (CITY) police department.

This is exactly 1 hour from my home and 45 minutes from hers.

I don't know why she sent a copy to the court..

Also, I am a stay-at-home dad to my step daughter and 20 month old daughter, so I don't have to work outside the home. The kids don't have a daycare, they have a babysitter that they stay with from school end until midnight every night excluding their mom's thursdays and fridays off work and my weekends with them.

That is just ridiculous. Why haven't you filed for custody based on the fact that the children are in day care until midnight? OKay I don't remember your entire story but jeez...

I have filed for custody based on this fact. The hearing is on the 17th of this month. As of today, she still works the 3pm-11pm shift leaving the kids in the care of a babysitter from 3pm-midnight Saturday through Wednesday, excluding the weekends I have the children.

a little background: they are the ones who moved out of a 4 bd into a 2 bd where my sons and daughter were sharing a bed.

true. Fortunately it seems to all be in my favor. This is where the kids want to be.

I will keep you informed after the hearing of the resulting judgement.

A judge would have to have his head so far up his ass that it's coming out of the other end to think your kids should remain with Mom and be raised by a babysitter. Is there no order for right of first refusal?

out of all the paperwork I have regarding this case, I have never encountered those words. What exactly is that?

Right of first refusal -- if the parent with possession of the children has to be away from them for a specific length of time the other parent gets first crack at watching them.

wow - how do I sign up for that?!

My kids have been in the care of their babysitter since December of last year, and I have no right to say any differently... yet.
