What is the name of your state?Alabama.........My question is this. I have full custody of my children with my ex having supervised visits. The supervised visits are because of alcholism and abuse. There has been several times that I have had to go pick up the children early or call the police to help me get my children because of his drinking and violent behavior. Now what I want to know is this.....I have a terminal illness and I want to know will my ex get automatic full custody of the children when I die? He is the biological parent of both children. I am remarried and the children have had a step father for 4 years that have provided for them and treats them as his own children. What are the chances of my children being allowed to live with him. My husband is the person both children have verbally said they want to live with. The children are ages 4 and 14. Any answers would be greatly appreciated.

im sorry, but your husband has no rights. your ex would get custody if something were to happen to you. they kids dont have a say in that, your husband is NOT thier father.
 
The only way to prevent that from happening is for his parental rights to be terminated. You will need to check the laws in your state regarding what qualifies for termination of parental rights. You really need an attorney if you are sure you are terminally ill so that you can prepare your will. Also talk to the lawyer about your children.
