What is the name of your state? - Ohio
I was doing some research and figured this might get some good opinions and advice. I am going to have my support order reviewed and have some concerns about current issues.
First the background: My ex and I divorced almost 3 years ago and at that time I have a very good job. She was only working 20 part time since our son was born so we could be home more and she also worked some for me (I was self employed at the time). We decided that since it would be best for our son we would go with shared parenting (every other week) and have been doing that with very good results for the past 4 years. Our support at the time was figured and then reduced due to the shared parenting. She was on paper to be the resident parent for school and formal docs.
Since then, much has changed for both of us. My business closed as the result of a fire in Oct 2001 and my income has taken a big hit. I have been working as a real estate agent since then so I could still be involved in my son’s life at home and school. I have coached various sports and just do all the things a 7 year old does.
As for the ex, she never did go to work full time because she was getting support from me. She has since remarried and had twins. When she got married she went form living in a 600.00 a month house payment to a 1500.00 a month house payment due to his income. After that they built a new house and purchased a new car, this all in the same year she had twins.
My concerns are two: #1 can my support actually go up since she now has more children and only works part time even though my income has decreased by almost half of what it was when we divorced?
#2 – When they build the new house they moved out of the school district to be closer to his kids from a prior marriage. In our decree it states that our son would go to xyz school (where I still live) and so there should be no reason for her to challenge this other than being mad about a possible support reduction.
From day one I have never been happy with support of any kind, due to the fact that I care for our son when she is at work, this has been consistent since the divorce because I have always been self employed. We also have complete everything at both homes, our son does not live out of a suitcase. Now I am finding out that since she has more children my support could actually go up?????
It should also be noted that when it comes to things my son does – we (the ex and I) have no issues about being at the same place at the same time, including parent-teacher conferences and other activities. We have both moved on with our lives – I just don’t think I should have to supplement her income any longer given the reduction in my own income, in fact I may even make less than her at this point.
