What is the name of your state? I live n Iowa the support is in Jersey

The state of IA has been taking $80 excess each week for 2 years. After much followup it was taken to court in IA to get corrected to the correct amt. The issue is the State ofIA sent documents on letterhead stating that cs stopped dec 8 when she turned 18. Jersey law is you pay until out of school and she grad hs june 07. Then probly college then it goes until 23.

What are the chances that we would be in worse shape if we take it back to court to have her emancipated in June. There has been very ltd contact as custodial(never married) , The custodial makes $50k and said she worked p/t and at $10 an hour and she makesover $20 an hour. She was in contempt of court for not removing his name 10 yr ago and we pursued thru her lawyer and it was finally done after the damage for 10 years of denial for housing etc.

Now the non custd- has a disabled spouse with MS and is now his dependant. Should not the fact of change of circumstances with moving to midwest marriage, disabled spouse now, and her contempt of 10 years and denying contact for 10 years. in addition to having a lifestyle of luxury with custodial has her momma's joint bank account, many ira cd's and the 200,000 house. They kep taking the child to scotland without court permission and now the child going to barbados no permission from court, the fact repeated trips out of the country should have been told to the courts!

What are the chances of winning in june?

Which state issued the last court order for child support??
Was the original order issued in NJ or IA or someplace else??

Iowa messed up the order and so tey did nunc protunc to get it corrected. All changes have to go thru jersey. That is why we could not understand how IA hd a hearing on it.

Original order in jersey and they hold all legalaties. That is where it got messy since their laws are the only ones around that say after 18 keep paying.

I have NO IDEA HOW Iowa could even try, nor why IA would WANT to try, to modify or enforce an order from NJ. :confused: How did that happen to come about?

Does the court order, or any modifications since the original, state that the NCP must pay for college support? If so, what is the exact wording?

They had the order for the set amount + 20% arrears well IA has been taking that amount plus a additional 20% so 40% and that for example a 700 check we receive 190 to live on for 2 weeks.

Nothing at all about college. We have just read that CS continues until they are out of school or age 23 at the longest. We have to take it back to court to get stopped or it goes onforever! NE and IA just stop you don't have to tie up the courts. Jersey they do.
We talked with his caseworker in jersey and finally he has a good one. She said to wait and try and get emancipated in June. We wanted someone to honor the letterhead that stated it ended on 12/8/06. The worker messed up as usual and sent out numerous letters and the attny general, the govr office in IA all were contacted we were told by the IA caseworker it goes by IA law since resident here 5yrs. We found out WRONG, Jersey rules and we have to take back to court but can ask for a phone hearing.

1. Contact denied 10yr
2. Lied about her income(custodial)
3. Kept his name on house for 10 yr denied housing repeatedly hard to get a job no house. Had to live in car many times. She got the house he bought even tho never married, 200,000 value. That debt was on his credit until last year when I pushed it with her lawyer. This order was in 1996.
4. Has taken out of country repeatedly when the child is still a ward of the court the court has to give permission and NEVER has the court or the non custodial been told until a month ago, when repeated calls and no answer.
5. Minor(adult) has worked $8 an hour f/t for 2 years and now traveling alone in my book makes her and adult and no support required.

Change of circumstances, the child is 18, the non custodial is married , in the midwest different cost of living and now has a disabled spouse. Not to mention bigger medical bills.

Since they have never been on the welfare, she obiously got a loan so makes good money as we already knew, and then all aong she was using his credit to get numerous side loans without his approval. They were NEVER I repeat NEVER married.
SHE IS WITH HER DOMESTIC FEMALE PARTNER NOW. Need I say more.
