I help a family that has learning problems - and are very disfunctional. The daughter was on her 3rd SSI appeal and was a victim to suicide before we could get her help with insurance/medications. They are all bipolar and many other health issues. The son is 46 and after more than a 3 year wait has been awarded SSI. He has never worked a regular job - he is bipolar and has only a 5th grade education. Reads at about a 2nd grade level.
He married 22 years ago and fathered a son - the marriage was short - the spouse was not aware of the family issues I am sure, and asked for a divorce stating that the new boyfriend wanted to adopt the boy that was a year old so she would not ask for support. The son signed the papers (remember he can only read at a 2nd grade level) thinking that the child had been adopted by the ex's new husband not aware that the divorce papers were showing $200 monthly CS payments. He did not hear from either ex or son for 16 years, and then received a letter from Child Support Recovery showing a balance of $35,000. child support. For the past 5 years he has been in and out of court for this, and in and out of 30 day lockup. The amount has now risen to $90,000. He will never be able to pay this amount, but I am going to try and set up a monthly payment with CS Recovery for him. The family cannot afford legal counsel. The mother is now 86 and the son has been taking care of her and him from his small amount of groceries from his EBT card. I am wondering if there is any way due to these circumstances that the amount of child support could be reduced. He will never be able to work at any job.

What legal authority do you have to try to set up a payment plan for back child support ?

How SSI money is to be used :


the beneficiary’s day-to-day needs for food and shelter are met. Then, the money can be used for any of the beneficiary’s medical and dental care that is not covered by health insurance, and for personal needs, such as clothing and recreation. If there is money left after you pay for the beneficiary’s needs, it must be saved, preferably in an interest-bearing account or U.S. Savings Bonds.

I'd suggest calling the bar association and some family Law Attorneys , to see if they could reveiw it on a pro bono case .

Maybe he could run it by legal aid .

BTW , I am aware of persons receiving SSI that wouldn't understand what's going on and still made to pay a small amount of CS .

Child Support and SSI

Thanks so much for the reply - I realize now I need to educate myself on SSI mandates. All CS recovery agents each time it was brought before a court would ask if he had documentation that he had applied for SSI and I assumed they would be attempting to get a portion of it for his CS Recovery. I definitely want to make sure the family follows the correct guidelines with this SSI. They can't afford to lose this benefit. Appreciate your help.
