Support collection suspension?

Starts out with Judge asking my daughters father how he was fired? He said there was no work so judge says you were laid off, he says yeah but I cant get unemployment because I didnt have enough time worked at that job. She says when did you get start working there. He didnt want to say because he had enough time to get unemployment he started in January and ended in Nov(in NY you need 28 weeks of employment). He says ugh well ughh, I cant get unemployment because I had collected an over amount last time I was on unemployment. So my lawyer asks for the petition to be dismissed because it lacks a form (from some family court law etc) and if he was fired and cant get unemployment he shouldnt be rewarded for his miconduct.

She says I acknowledge that and agree becasue she has to follow the laws and he has the ability to make $45000 a yr, He says I cant find a job as a construction manager because I dont have the college exp and someone got me that job etc. Even construction laborers and workers make $30000 ( which is about how much our support order is based off when we agreed to lower amount). My lawyer says that there are construction jobs available because last modification (and added that this is his second modification petition) that his previous boss* testified that there are plenty out there year round. My daughters father says well Ive talked to ppl who still work there and they said that he was just doing it to get back at my daughters father and bust "his ba**s" his exact words etc.

Judge asked him where he applied at and he says well I applied at a few construction places( didnt name specifics)*but they are laying off etc and he applied at Walmart they arent hiring. She asked how many applications did he put in the last week he said none. He said They just had a baby last week of Dec and the baby was premature and the wife has kidney problems and he has to take care of the wife, baby and get the step*kids off the bus (ok now youngest is about 14, the rest of kids are 16, 18, 20 they cant get the 14 yr old off the bus? hes not handicapped or etc)*

The woman granted a suspension of support for 4 weeks (ends up being 7 weeks cause we go back on Feb 26th).

He was like why cant you modify this right now and give me a break, Ive been paying all yr round and I cant do this I cant work cause I have to watch the baby and take care of my wife etc. Once I find a job I will notify the court like I always do (yeah right thats why last yr he was hired in Jan and the support unit couldnt find the place until I gave them the exact address because the judge made him give it to him and told me to go to unit and give them the address. Didnt end up being garnished until June). Then he says after this time im just going to have to file again (meaning another modification petition).

Then he says hes borrowing money from family for bills etc. She says did you pay any support with that money, he says no I didnt have any left after bills.

Anyone ever had to deal with a support collection suspension before? The lady said his arrears dont go away just puts a hold on them. But as soon as he finds a job he has to tell unit and then that order for suspension stops. If not it stops on day we go to court. What if he doesnt find a job will she arrange a hearing or do I have anything to worry about here?

You post is a little confusing to follow , but who is SHE that you keep refering to ?
A Judge or a hearing examiner ?

Are you in Family Court , or divorce Court ?

I kind of "deciphered" this because I have been in pretty much the same position, where CS was suspended by the family court until further action of the Superior Court. UGH! What a hassle and then when all of that was happening, my account with "support and collections" ended up getting closed! Real mess, so I know what you are going through. The "arrearages" dont go away. Mine were suspended by a family court magistrate and the Superior Court Hearing Examiner reinstated.

It was explained to me that when he does have to begin paying that the original court order stands until changed (mine went upward). So, yes, the arrearages will accumulate. You dont have an attorney do you? TRUST ME. I went pro se and did mighty fine until the end. I HAD to hire an attorney and guess what? He is ordered to pay MORE than he was in the order he fought!

In my case the magistrate (i call them judge thats why at top I did so) suspended it until Feb 26th court date OR until he finds a job (then he is supposed to tell unit-i know he wont so im not holding my breath). Hes not going to let it end he already told the magistrate he will file again if he doesnt get it.

Did you file for the upward or did they just do it on their own. I personally dont think my daughters father will have a job by then. What do they do then, do they set up a hearing. Hes actually getting 7 weeks instead of the four that the judge originally gave him. I do have an attorney hes good to me (i was referred by a family member who went to school with him), he was asking for this to be dismissed because it was missing a part of the affadavit that goes with the petition and because him being fired and not being able to get unemployment represents misconduct on his part and should not be rewarded for it.

My daughters father contradicted himself all throughout the "appearance". He first says he looked for work but then only mentions applying at walmart. Then says he cant go apply because wife is at home (just had surgery after having a premature baby Dec 22nd-must not need too much help if the baby is home after a week or 2-I had my daughter premature and they dont let you go home that quick if the baby is real sick-he could be lying about having the baby too so who knows I dont believe anything that comes out of his mouth). Her older children could help her there is a 20 yr old, 18, 16, and 14 yr old). Oh but those are the kids he mentioned having "to get off the bus" so he cant work because of that either.

Sorry I was trying to keep it shortened but get the important facts (so i thought) in there.

SHE is the Support Magistrate...Family court.

He filed for modification saying he was fired and he cant get unemployment. This is 2nd mod. The last one was dated Jan 18th (for first appearance) only that time he quit his $45,000 a yr job to work at the $300 a wk job.
He didnt get that either only had temp relief of 3 months paying $25 a month all while he got to keep his cell phone, internet, and other bills that add up to $3,000 a month (no he testified his wife doesnt work and his wife doesnt get any support for his step kids). Soemthing odd is going on and he just doesnt want to pay at all.

If you do not agree to the final order , you have 30 days to file a line by line written objection . You should get these instruction with the copy of the orders .

What if I disagree with the child support order that is issued at the hearing?
If either parent disagrees with the support order, he or she has 30 days from the date
the order was made to file a written objection with the court clerk’s office. A judge will
review the case file and decide whether or not the order should be changed.

I go back to court in 7 weeks would be no sense.

The order is a support collections suspension until Feb 26th or until he gets a job. I believe she is only giving him time to find a job. I was just curious if he doesnt find a job could they grant him a trial right there or dismiss it like we asked.

It seems that with Support Magistrates it can go either way. I have seen and heard of some doing things that completely contradict the law. Hopefully your attorney will get his mod request dismissed. BTW - I wasnt going in for mod when mine went upward. It seems each delay, each action and each interaction causes him to have to pay more while I sit back and shake my head in wonder. So......you never know what can happen in court. Good luck and just be patient.
