I was divorced in the State of Wisconsin 4 1/2 years ago. My ex was ordered to pay support based on the MacDavis formula. I am considered part disabled, I have been evalulated by both a State of Wis, evaluator and a private one (twice) during the divorce. I can work, but it should be of the secretarial type. No heavy work or long term, on my feet. MacDavis was formulated based on my projected income, if working full time. This was a 23 year marriage.
Recently my ex lost his job as an design engineer. Receives top unemployment, plus works part time at new wife's retail employment.
I had been working part time until last summer when I finely found a full time job. Right now I am working both jobs, about 65 hours a week, trying to get all my outstanding bills paid off.
My ex has now decided that he should not have to pay me any more support. Hired another lawyer and is taking me back to court to have support completely stopped.
I had offered to take 1/2 of support for now until he finds another job, usually he could always find a new job in 3-4 months before.
His support pays my house payment and 2nd mortgage from all the outstanding bills.
I cannot continue to work the 2 jobs much longer, it is effecting my health. I would like to quit the p/t job in a month or so. But now, as I get my feet back on the ground, they are being kicked out from under me again.
Furthermore, I have received no support from him since the beginning of Feb. I do feel that he is in Contempt of Court.
This man has dragged me into Court about every 18 months since the divorce, over this support issue. I cannot afford to hire my lawyer anymore. I still own him and am paying off from the last trip. Any advise/direction would be appreciated.
