Our car got cited for being partially parked on a handicap zone. I was not driving though when the cop came I was outside the car buying something at the store my girlfriend who was driving the car is getting treatment at chiropractor. I had asked the cop why he was citing the car. He then pointed out that the 2 tires were passed the disable lines. I tried to reason with him. Then he asked if the car is. registered and insured and asked for them and my license. I forgot about my license being suspended and handed that to him together with the registration and indsurance. He then gave me a ticket that states "DL suspended" but nothing on the car being parked at the handicap space. Am I suppose to be charged here w/ a moving violation? Because this is what suspended my license again for the second time after I had renewed it. It took only a few weeks then they sent me the notice again. And suspended my license. this is in california

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Ok, not really sure what you are asking. From what you wrote, you got a ticket for driving with a suspended license but not for the original reason he asked for your info (the disabled parking thing).

Ok, if it is your intention that somehow you were ok to park in the handicapped area because of your girlfriend's chiropractic care, it may be a good argument, but you weren't cited for that.

Either the officer just forgot to cite you for that or decided instead of giving you two tickets, he'll ticket you for the more serious one--driving with a suspended license.

Not sure what you seek.

The answer is no! You should not have been cited for a moving violation, get a lawyer and make sure your gfriend, the actual driver will be in court also. and if everything you say is true you should be successful, I would also get a letter from the chiropractor your friend had an appointment with, stating she was there at that date and time, and that she was in a condition to drive herself to add credibility to your story

I am not a lawyer, this is not legal advise, I highly advise that you speak with a licensed attorney in your state, prior to taking this or any legal action
