Our GC was pregnant with twins at 16weeks after I fought for her to get to dr for an appt we found out both babies hearts had stopped. I asked for her to hold off induction until we get up there the following day. She didnt then I asked her to get her weekly bloodwork to ensure her levels were fine she said ok but found out she didnt. I asked her to tell hospital we want full autopsy on both babies including toxcity levels (explained not accusing her just needed to make sure accidently nothing caused) she said ok but now she called a week 1/2 ago said dr called report says genetically both babies were 100% fine when I asked about everything else she said guess they didnt do it I will go pick up report , mail to you and ask about the others.Now she is not returning any phonecalls and/or emails something is going on In contract is specifically states if negligence then all monies paid out regarding surrogacy including lawyer fees and medical fee is to be repaid in entireity. I also think she told us at 12 weeks everything was fine at her 14wk appt she said dr looked at her heard both babies and didnt get the rate and for her not to come back until 20 weeks (which I feel is lie because I lost my twins at 20wks so not sure why they would have such a delay for that reason and for twin pregnancy. Along with in contract it reads once a month appt. Only thing I can come up with is she gets two more payments out of us. For the contract she signed medical release but when I sent to both ob and hospital they state it is no longer valid since dated 2/05 (date of contract) is there anything I can do 1) go after her for money and 2) how do I legally get these medical reports to see what happened? I have 17 embryos frozen and will not go forward until i read these reports and make sure it is not us ..If babies were born (which we picked them up and buried) once they are born shouldnt they legally be mine and my husbands and we at least have rights to autopsy reports ..Genetically the babies are mine and my husbands..thank you in advance
