I was wondering if someone could help me please. First off, I'm in New York state. Can a judge suspend a parents rights due to something their parents did? For example, my boyfriend has not been able to see his daughter in over 3 weeks because the mother is a you-know-what and very jealous of him having me in his life. A couple of weeks ago, she stormed in his house, actually his parents house, and grabbed her daughter to take her out of the house, and his mother hit her. To make a long story short, now she's filed a petition to have his visitation rights suspended due to unsafe environment because of what happened, stating that their daughter was injured at that time, which is totally untrue. She also stated in the papers that he leaves their daughter with his mother when he does get her, which is also untrue, and that she feels that he is neglecting their daughter, and the daugther is showing signs of anger because of this. Well, hello!!!! She's only 2 years old......all 2 year olds act up, isn't that the reason why they call it the "terrible 2's"????? Someone help me!!! Wouldn't they just let him see her, even if he has to be somewhere other than his parents house? And also, she has violated the visitation court order, has been for over a month. He's seen his daughter once in almost a month, and he's supposed to see her two times a week, and overnight at that. She's only doing all of this because she's jealous that he's with someone else now. We're also looking at buying a house, so if he's out of his parents home, would that make a difference also? His parents home is definitely not an unsafe environment. She has just done so much to him and his family that his mother kinda just lost it finally, that's the only reason why she hit her. Please help me!!!!!

I'm not a lawyer, but a petition is very different from an order. A petition asks the court to do something. Until the order is granted, it seems to me that she is in contempt for refusing visitation. Of course, you have to file a petition to have the court find her in contempt.

Yeah, it is only a petition, but I was just asking anyones advice to if they thought a judge would take away his visitation rights because of something his mother did? And yes, we already filed a petition for her violating the court order, in which they will take care of the same day we go to court for her petition.
