Suspension from school

My eight grade daughter was suspended for two days for, according to the discipline notice, "use of inappropriate language". The teacher that sent her for discipline alledges that my daughter called her a f...ing b..ch.

Here are the facts.
1. My daughter received her test back from this teacher and she only received an 80%. When my daughter looked at the questions she got wrong she realized she had erased the correct answer she originally had recorded and second guessed herself and submitted the wrong answer. Being frustrated and angry at herself she mumbled to herself, but evidently loud enough for the teacher to hear "you stupid b ch, referring to herself. This happened on a Tuesday.

2. On Wednesday morning I spoke with the teacher, I still had not seen the discipline notice. I told the teacher that Kate was truly sorry for such a slip of the tongue but in no way was she referring to her (teacher) when she said this. (Please remember I still don't know what is on the discipline slip). The teacher's response was "I know she wasn't, she was just frustrated with her grade". "I spoke with Katie this morning and told her that everyone makes mistakes and not to worry about it. It's all been forgotten.

3. When I picked Kate up after her newspaper meeting at 5p.m. that afternoon she informed me she had been suspended first thing that morning. I haad not been called or notified of any suspension and Kate was allowed to stay in school the remainder of that day.

At this point let me tell you that this is the first time in her life that Kate has had any discipline problem in her school career, her lowest grade on her report card was a 97, she is on dance committee, yearbook staff, editor of her school newspaper and in no way a trouble maker.

4. I tried to reach the principal for the next two days and unfortunately, although he did return my calls, we were unable to touch base on setting up a meeting.

5. My family and I left on vacation during spring break and upon returning I called the principal again. I was able to speak to him this time. I requested a meeting be set up at their convenience with himself, asst. principal, the teacher, myself, my husband, my daughter and a representative from the superintendants office. The principal refused to get the teacher involved into this meeting. He also told me the teacher told him that she didn't tell me she knew Katie didn't say that to her. I then called the superintendants office. They called the principal and he is still refusing to set up this meeting.

I know at this time it is impossible to get back those two days for my daughter, but I do want to have this suspension removed from her record as there is nothing in the student handbook of using offensive language, except when referring to a staff member.

Please let me know where I can go and what I can do. We live in South Carolina.

Gotta love the school system today. But the problem has its roots in your daughter's mouth. Had she held her tounge there would be no problem at all and to brush it off is telling her that every-once-and-a-while she can behave inappropriately and get away with it. But legally, in my opinion, the school suspended your daughter illegally. 1) they should have called you upon deciding to suspend your daughter and 2) your daughter didn't break any known rule. Call the superintendent and tell him/her that you can either have a meeting at school with all those people or you can have it in court.
