Taping phone calls?

I am in a unique situation and hoping someone can point me in the right direction.

Q: Can an atty tape your conversation with them if you are NOT a client?

Q: Second, if information is left on a voice mail for an atty can they in turn use the recording for "find you" or play it for the other party?


It's a twisted situation that promotes this questions, but before I react I have to know. Thanks. :) :eek:

What is "find you"?

A voice message left on an answering machine or voice mail is legit because the caller (who is leaving the message) is aware they are going to be recorded.

In regards to anything else, you need to provide specifics.

you first need to find out

If the state you are in is a two party consent state or a one party consent state.

In a two party state they would have to advise you before hand that the call is being recorded. In a one party consent state they dont have to tell you that they are recording it.

If Ohio is one party consent the lawyer has every right to tape your phone call without you knowing about it. The law gets a little more tricky if you and the person taping live in different states.
