tax returns...and back cs payments

My daughters father stopped paying in March.... he notified DA that he no longer worked at his job (of 11 years???) so 2 months later ..no support...called DA and they said they can intersept his Federal State Income tax return...? They already took a little (and I mean little)from his State, and that was in March, so shouldn't he have already gotten his State by now? They said they would suspend his license, but this all takes some time......1400.00 he owes, but he just bought a new car, and applied for a American Express CC, meanwhile IM the one struggling, and wondering what are my rights, or what should I do? :confused:

Ummm, maybe he did not HAVE a refund coming on his Federal return? A refund ONLY occurs if one overpays their Federal withholding AND owes nothing in additional, back payments, or penalties on their Federal return. If he lost his job in Sept, maybe he had not paid in enough to have a federal refund, especially if his annual income included a December bonus.

And yes, people can an DO lose jobs of 11 years or more. I (13 years) and several others with a dozen or more years lost our jobs last year as my former employer tried some revamping, eventually closing that branch. Of course, my husband and daughter had no government guaranty that if I became unemployed, our household would not need to experience any drop in income.

Income tax return interseption can take quite some time. After the return is filed and accepted by the IRS, a letter is sent to the taxpayer (your ex), informing him of the CS debt owed. The IRS holds the tax return, giving him 30 days to respond. There's not much he can do to stop them from send the return to you unless he has an order signed by a judge as proof that he does not owe the money. However, if he has remarried, his new wife can file for 'injured spouse' status. Reguardless of whether or not she earned any income for the year, she would still be entitled to 50% of the return (more if she was employed). Once the IRS sends the return to the state, it depends on the state you live in. In TX they hold the money for 120 days in case there were any mistakes along the way. You should be able to call the enforcement office and get the info for your state.

As to him losing his job, after 11 years, he should be getting unemployment of some type. If so the order should have already been sent to the proper office. Good Luck!
