What is the name of your state?VA After a full year of visitation with my 2 yr old daughter, I'm starting to pull everything togeather. I have joint legal custody, and I'm wondering if the court will let me claim my daughter on my taxes everyother year. I work full time and the mother who is the Custodial parent doesn't work at all. I suppose her husband is claiming our daughter presently. This wasn't talked about in the original proceedings because I didn't care about anything other than getting to see my daughter. She won't agree with me to do anything outside the court order so theres no chance of making a decision on our own. I have, I guess.... the normal visitation which is everyother weekend and 1 time a week for 2 1/2 hours, as well as a month in the summer. Is there any chance do you think That I could get more time with my daughter if I went back to court. I have missed no visitations and there have been no problems to date. The mother still doesn't want me to have anything to do with our daughter. But now she can't do anything about it. I was also wondering how I should go about getting my girls medical records. I think I know who her pediatrician is and I know where she was born. Is there a centralized place where I can get all of her records or would I have to go to each individual place she has been to. Her mother says she has had no shots to date and despite me telling the mother she NEEDS those shots. She won't get them started for fear of our daughter getting sick from them.....which is kinda retarded because she could get more seriously sick without them. Looks like I'm going to have to get them started, but I want to have all of her medical records before I do. Just to make certain she hasn't started getting shots already without my knowledge. Thanks for any info.

You are entitled to your childs medical records under VA:

§ 20-124.6. Access to child's records.

Notwithstanding any other provision of law, neither parent, regardless of whether such parent has custody, shall be denied access to the academic, medical, hospital or other health records of that parent's minor child unless otherwise ordered by the court for good cause shown.

There is no central registry, you have to locate the right doctor.

You need to have a change in circumstances in order to modify the original custody agreement, do you have one?

You can try fighting it out with the IRS, but since the child lives with the parent & there is no court order otherwise, they will probably tell you tough luck.

As for vaccinations, VA is the home of both:

It is a simple matter of having a notorized statement from the Health Department in order to reject vacs under freedom of religion.

Good Luck!

I think I will get a better answer from the court then tough luck as far as getting to claim her everyother year. If the mother has no job it seems to me that it would only be fair and benifit everyone including our daughter. As far as the change in circumstance, That could be anything. I recently finished college so I have more time on my hands. I have only been able to see my daughter for the past year and she's now 2. We have a great relationship and I would like to build on that before she goes to school. And basiclly its just not ****ing fair That I work all the time and only get to spend 2 full days with her a freakin month. meaning from the time she wakes up to the time she goes to sleep. How screwed up is that. Sorry. What is the courts idea of change in circumstance? any ideas?
