A person I know lives with her fiance in leased rent control luxury apartment in Santa Monica, he freaked out one night on a control issue took her close to death was arrested bailed out then skipped out of the country to avoid a permanent restrain order.

He contacted the main desk of the building and told them not to let his fiance upstairs to her apartment, they cooperated and stopped her from entering her home, the police were called they said its a civil matter.

She cannot go home nor can she get any of her belongings, clothes etc the building main desk said the only way she can go into her home is if she gets a warrant.

The facts

1: Her fiance is only one named on lease
2: The building issue her security passes, valet passes, lift passes and sets of keys for the apartment when she first moved in back in April 2006.
3: The building main desk told police she is a resident but they were instructed by her fiance to not let her back in.

I would have presumed this was an illegal lock out but it seems like police just scratch their head and rent control scratch theirs as well, rent control said we are not sure but if your name is not on the lease you can be locked out!

Is it just me or is there something wrong here any suggestions what she can do?

Your friend needs to contact a asupport agency / group for survivors of domestic violence immediately.

They will have delt with worse situations, and they will be able to help her with her things and finding a new housing situation.

Bottom line, she can't stay in his appartment. Its not healthy. Move on.

Moving on is not the problem... its the illegal lock out access to her apartment to grap her things that is the problem, I spoke to a watch commander quoted the penal code 418 and the commander just muttered and said take it up with court system.

The watch commander is correct. Since your friend decided to live there 'illegally' (without her name on the lease or any other VALID proof of her tenancy), she has no standing in attempting to gain access.
Her ONLY recourse is to pursue her case in civil court.
