We just moved in this home 2 months ago, We where aware of a mildew problem and was told it would be taken care of by the lanlord. Well it has really gotten bad and its in the basement, I went down and saw that the walls are covered with mildew, and one wall (outside wall ) is actuallysoaked becuase of the water damage. My question is Do we have to hold to our lease ? Can I withhold the rent check until he fixes things? can I deduct money from the rent to have it fixed?

Write to the landlord and tell him you want the problem fixed which has turned into a health issue or you will require him to release you from the lease.

If landlord does not budge call a city inspector in.
