My husband had a child with a woman who he had met once. Not knowing who the father was, she served 2 other men for paternity, before she served my husband. The child at this point is 2 years old. When child support was set, she called my husbands attorney & asked if he would give up his rights, as the child new her current husband as her father. Once she started to receive child support she no longer wanted to sign the papers. Although she doesn't want the biological father to have any rights to the child. Can he give up his rights???

He can give them up if the step Father will adopt the child. If he does not want to adopt the child, no.

If your husband wants to have "rights" to the child, he will need to file for visitation. Regardless, if there is no one to adopt the child; he is financially obligated to support that child.
