What is the name of your state (only U.S. law)? FL

On Dec 31,2008 I was arrested for domestic violence. Since then I've gotten divorced and paid dearly for the 8 month marriage. I was divorced Sept 2009. I've never been arrested before and I my first wife of 10 years will attest I never did anything like what was alleged.

I never touched her but took the diversion program because 2 lawyers and more importantly her second husband told me "You don’t want her to get on the stand, she’s an actress. She’s a pathological liar." She punched herself in the eye and used makeup to fabricate a black eye. Took pictures herself then called 911 14 days later. FWIW, I did not know she had a second husband until after I got out of jail, when my brother did an online search for her, then I called her first husband in the UK.

One of these days I'm going to write a book. In the meantime I want to get the injunction removed. how long does it take and what do I have to do? I have no desire to pay another lawyer (ever again). After over 2 years why wouldn't the judge remove it. The court records (perhaps her lawyer wrote this) state "permanent injunction", which as I understand I cannot own firearms and if I ever run into her at a store I can be arrested immediately form coming within 500 feet of her.

FWIW, this woman has harassed me beyond belief. Going on 3 years, I've been harassed by her. I've learned that she is really one of these Antisocial personality disorder - Wikipedia, the free encyclopedia . She gets off on harming people. I'm not the first; she's been doing this to people for a very long time. she's brillant in a deviant way. She's filed 2 State of Florida Ethics complaints against me, (I work for the State) the second one goes in front of the commission tomorrow. I'm not worried, I didn't steal from the state as she's alleged.

She filed 2 Federal lawsuits cases against me, an FDLE complaint, and a FBI complaint. She has FOIA'ed ever State Attorney's office in Florida as well as my office numerous times, the PDs office, clerks in Orange and Seminole County, and other govt entities that I've worked for across the country. All of this was used to create a 200+ page ethics complaint that will be thrown out tomorrow.

Luckily, last year while I was checking on the status of my federal cases I saw her bankruptcy. ~$330,000 bankruptcy; the lawyer that was so vicious against me lost out on $26,000. Now she has no lawyer to use in her threatening civil case against me.

Among many, many other things, I believe she's poisoned me and my daughter when we lived together. I put 2 & 2 together when I began speaking to the second husband. He told me "she put lysol on my steak and served it to me", she put him in jail 6 times, took over his home and robbed him of everything (happened to me too). Her first husband told me she once stabbed him with a potato peeler. He also gave me access to portions of his 137 page child custody document where court records describe her psychotic behavior in the 90s. He wasn't seeking custody, Officials in Mass sought him out.

I didn't do it. Yes, I attempted to tape her in hopes that she say something about punching herself. I paid dearly for that.

The make up black eye does awesome for that sort of thing....pencil lead gives a great looking black eye if your a guy without makeup......

I know what kind of woman your dealing with......good luck

I appreciate the comment. I'm much better. we're working on year 3 and there isn't much more she can do to me. It was difficult for a while. I had to be very careful with anything I did because I was on probation for taping her.

The first federal lawsuit claims my brother and I obstructed justice by tampered with witnesses from December 2008 - October 2009, "defendants, individually and in concert, maliciously conspired to interfere with the Plaintiff's civil rights, to deter the Plaintiff , a witness and party in separate state court actions, by force, intimidation or threat from attending court or testifying freely thereby causing injury to the Plaintiff in violation of her civil rights. As a result of Defendants' actions, Plaintiff has suffered deprivations of the rights guaranteed to her under the Fourth and Fourteenth Amendments of the Constitution of the United States."

It also states that I caused intentional harm by having "charges brought against an innocent woman and victim of domestic violence for the sole purpose of scaring her so she would not cooperate with he state and to deter her from being a witness for the state." (I filed a complaint (and Suntrust bank did too) for forgery on my HELOC account for 2 checks $2000 and $5600. ...because of the arrest she was deprived of her rights under the 4th and 14th amendments.

She wasn't granted indigent status so it didn't go beyond filing. I believe the cost to file is $400.

The second lawsuit claimed I violated her rights in Amendments 4 and 14th for the charges in my arrest of interception of oral communication. After a few months and a bunch of motions and filings she voluntarily dismissed it.

both of these cases were done pro se.

I still would like to know what others feel about getting the injunction removed. How long does it normally take before a judge will allow it to be removed?

It sounds as if anything you do in regard to the injunction is going to stir up the situation again. Taking everything you have said as true, it sounds like this woman is capable of really harming or even killing you or someone else. Maybe I watch too much real life crime tv, but these things do happen.

If I were you, I would leave it alone.

thanks for the comments. that's part of the reason I haven't attempted to get it removed, yet.

I once got a call on my answering machine. it was from the first husband, he left a message "I can't believe you've done it again". Approximately 14-16 years after divorce he was still feeling pain. Someone anonymously called the British DCF on his child care business. He got audited because of the complaint. There is no doubt in my mind where it came from, and neither his. It ended up being unfounded and he knows right where it came from.
