What is the name of your state? California

I have been working for a Car Dealership as a manager for 2 years and was let go for "having the wrong temperment in my position". I have never had any confilcts with co-workers, patrons or guests in my work history. Let alone any kind of verbal/written reprimand on any occasion. When I asked for the basis of this desicison, no proof could be given or cited. What can I do? There is no validity in this basis.

Also, when terminated, I asked for a final check and was told you will have it in 2 weeks. I thought 24 hours is the max in my state to be given a final check?

Someone please assist in this matter!

From the CA Department of Labor's website?

An employee who is discharged must be paid all of his or her wages, including accrued vacation, immediately at the time of termination. Labor Code Sections 201 and 227.3

If your final pay check was due immediately at time of termination (which per the labor codes moburkes refers to it seems it should have been), you can file a complaint with the Div. of Labor Standards Enforcement or notify the Wage & Hr. Div. of your state's DOL.

And just as an FYI, letting you go for having the wrong kind of "temperment" for your job is perfectly legal, even if you disagree, and even if your ex-employer has no actual evidence of this.

AND, the DLSE can also order waiting time penalties, payable to you, for each day your check is late. The only POSSIBLE mitigating circumstance is if you are paid commissions only, and the commissions are not yet able to be calculated.
