if we file to terminate a mothers rights because of abandonment for 16 months and she calls us after we file, do we have to talk to her?

Who is "we"?

There's no obligation for the other parent to answer the phone. But if Mom is going to object to the petition after being served, the other parent NEEDS an attorney.

And the other parent needs to face the possibility that Mom is going to be allowed to come back and be a parent to the child/ren.

Also, you'll need a very strong case to win a petition like that against consent. Better study your states statutes and case history.

You don't have to speak to her, but dad will have to deal with her in court.

If you are not dad, then you are a legal stranger and should stay away from this particular situation.
