What is the name of your state (only U.S. law)? I live in California, however the court case that names the biolagical father is in Virginia. I would like to find out how to remove the bio father's name from the birth certificate so that when i get married next year, my husband will be able to add his name and become my son's father. I have not recieved child support from the bio father since, June 2002. Can i remove his name on the basis of abadonment or not? Thanks for any help, anyone can provide me.

You won't be able to do diddly about that until you are married and have been married a while. Judges like to see that a relationship is going to last before they'll allow a step-parent adoption.
