What is the name of your state (only U.S. law)? nevada

The father of my baby that is 3 months agreed to terminate his rights if I place him up for adoption but I really want to keep him. A friend of mine agreed to adopt him and then sign him back over to me once his rights were terminated. If I don't give him up the father threatened to take him or fight for custody just to spite me he never wanted him. is this possible?

No, this isn't going to happen.

Adoption is PERMANENT. What you intend, is fraud and the court will not allow it.

thank you for your answer. I love my son and don't want to give him up but the thought of my abusive ex getting custody of him frightens me. He mentioned that if I ever left him he would hire the best attorney money can buy and take our son then let his parents raise him because he wants nothing to do with him.

That's also not going to happen.

You're unwed, and by the time it gets to court you'll have status quo on your side - this would make it (even with Johnnie Cochrane as his attorney) difficult for your ex to get primary custody. Even IF he got primary, he's not going to be allowed to have his parents raise the child in his absence.

He will, however, be entitled to joint legal custody (as a general rule), with the usual NCP visitation. If he wants it, he'll get it.

thank you again. I have already been thourgh a nasty divorce with child custody and when I found out I was preg. again even after him having a vesectomy he threatened to leave if I didn't give up the baby. I thought great at least I won't have to deal with custody issues this time since he didn't want him but I guess that is not the case.

Based on your posting...I thought you were 15-20.

That you are 30 is surprising.

You should consult with an attorney in your area to deal with this. Do not attempt to go Pro Se.
