My SO was divorced in NY 2 years ago, he actually moved to Texas 4 months before the divorce was final, that is where we live now. Here is the story: Married 25 years, 2 adopted children both over 21, quit job in NY to move to Texas (yes for OW), wife filed for divorce, he had no lawyer (paid for hers). He paid for her college education, she graduated 3 months before they seperated. He cashed in his 401K to pay off the mortgage on their house and signed it over to her 100% with all its contents, he paid off her car and credit cards, paid property taxes on the house for that year, gave her $2500 cash, paid her $650 a month alimony for 8 months ($5200). She also asked for $650 month alimony and at the time he agreed to it. She has a college degree and got a full time job 2 months before the divorce was final. He is in Texas now and unemployed since March 2001, has not sent alimony since then. She has filed for non payment (in NY). We have hired a lawyer to file for alimony termination, he has no money and doesn't own anything. I work and support us both, we are not married. Even if the court denies the termination he can not pay her now nor plans to in the future. Is he safe as long as he never goes back to NY? He has no car, no bank acount, nothing she can take. She can put it on his credit report but we can live with that. What we want to know is how far will an out of state court go to collect alimony? We don't plan on setting foot back in New York again. If they file contempt in New York will they come to Texas to arrest him, if so do they take him back to NY? Any info would be helpful. Thanks....
