Termination of Father's rights without his consent

I live in Alabama, and I have a 3 year old little boy. His biological father has not seen or talked to him since he was 10 months old. He has not paid any child support. I have recently remarried a wonderful man who loves my son dearly, and would love to adopt him. I do not believe that my ex-husband would give up his rights willingly, even though he clearly doesn't wish to exercise them. I guess my question is, is there any way that I can have my son's biological father's rights relinquished without his consent. He clearly does not care for this child, or is not ready to be a father. For whatever the reason, he is not being a responsible parent, or any kind of parent for that matter, and I believe that my son deserves a Dad that loves him, and that he can respect. I am desperate for answers. Please help me in any way that you can.

Is there an existing court order for support? Is there an order granting visitation?

The court ordered him to pay child support in the amount of 187.00/month beginning in May of 1999. It took us from September until May to get the divorce. His father would not show up for court, and when he finally did show up, he did not have a lawyer, and the judge gave him time to get a lawyer. Needless to say, he never brought a lawyer with him to a single court appearance.

He was also granted visitation rights. Supervised until Austin turned 2, then every other weekend. He has never exercised these rights. My address has not changed. His sister has came to see Austin a few times, but never him.

i live in salt lake city utah and i am also trying to get my sons parental right taken away without his consent the court has to find his father unfit or a danger to the childs life. abandoment in utah is one yr of no contact with the child. but i am unsure of what alabama laws are hope i could help good luck
