Well, someone has to take on her resonsibilty of rearing the child. Let's say she recently had a baby and her and the father gave up the baby for adoption (and it's finalized).

Should she change her mind and decide she wants to be "mommy" again or play an important role in this child's life, it will be up to the new parents to grant her request. She is not responsible for the well-being, supporting with money or emotions, etc. But she also will not have a say in how this child is raised, where it should live, where it goes to school, religion, etc. If the parents decide to let her be involved in the child's life, it is totally up to them. She's basically just another person on the street.

Think it over carefully. It's permanent. (There may be more, but I haven't gotten there, yet. I was on the new parent end.)

She can TRY to terminate her parental rights, but unless there is an adoption pending, she is probably SOL.
In addition, I don't think that NJ is one of the states that allows termination of parental rights to include child support. Therefore, all she would be terminating is her rights to ever have custody/visitation/ or any say in their lives (even if he dies)...but not her obligation to financially support them.
Perhaps if her ex is remarried, his new wife might wish to adopt the children?

Termination of Parental Rights

Just relaying more info.....She is remarried and her ex has joint custody. She wants to remain paying child support, she just wants them out of her life. New hubby agrees. I dont really know the whole story, it's just that she wanted me to ask what all she had to do to terminate her rights, but she does know that she is still liable for c/s. Guess she just wants to not have any rights......Any more advice? Thanks all!

She'll have to file, it could be called motion to terminate parental parental rights (depending on the area) She'll have to list a damn good reason on the motion. The ex will be able to respond. It goes before a judge. We can't tell you what the judge will decide. But what is her reason? It might not even be worth it to bother filing...

Agree with mommatiger. Imagine being that child 10 yrs down the road and finding out that your bio mom doesnt want anything to do with you. My step-children are going through that now and I wouldn't wish that on any child. Remember, just my opinion!

Take care of the ones you love.
