My husband and I sign our parental rights away to our two children in the state of Georgia. They were then adopted by my mother and stepfather. My mom and I, I thought, had a verbal agreement when she died I would be given custody of them. She died in 98 and now my stepfather has moved to North Carolina with them and I believe they are being abused emotionally by the "new" gf, are constantly moving around and actually stayed with me for 2-3 months because "he justed couldn't handle it anymore." But when I asked for some(not all) of the SSI they received to help me out he came and got them. Is there anything I could do to gain custody?

My response:

No, there's nothing you can do.

For all intents and purposes, both morally and legally, you are no longer your childrens' parent. It's over. In fact, it was over years ago - - and the promise your mother gave you was unenforceable.

Additionally, you cannot take from their Estates, and they cannot take from your Estate.

In summary, your "children" are as much legally yours as they are legally mine, and that's none.
