A little over a year ago, my daughters father gave me full physical and legal custody of our daughter. At the time we were living in Pennsylvania. Once he gave up custody, my daughter and I moved to Texas to be with my husband who is active duty army. It has been over a year since we have lived here. I have not heard from her father in any way, shape or form. Not a letter, text, phone call or e-mail. He has made no attempt to have contact with me or our daughter. My daughter is milidly autistic, and has been in my care the majority of her life. Her father is not paying any type of child support, due to the fact there is no order for it.

My question(s) basically is "if I were to file to have his rights terminated so my husband can adopt her legally, how would I go about that, and what state would I file in?" and "when is it considered abandonment"?

I have done my research and I have reasons as to why it would be best if my husband adopted her.

You need an attorney. Adoption is NOT DIY. And it would happen in Texas.
