I live in Texas. I received a ticket 7 years ago. An undercover officer said he saw me driving failure to signal my turn and perform an unsafe lane change. He radio'd ahead to another officer who pulled me over and wrote a ticket. I'm scheduled for trial next month and I want to know was it legal for the other officer to write a ticket for something he did not witness and the violation is so old, is there a statue of limitations on class c misdemeanors?

Why did it take seven years to go to trial?
Yes, it's legal for the ticket to be written in such a manner. I suspect that, after such a long time, the officer(s) will have no actual recollection of this event. As such, so long as you handle the trial properly, it should be thrown out.

The statute of limitations ceased to become an issue when the ticket was issued.

What you would like to argue is a speedy trial violation. Alas Texas has no concrete rule on that. You have to show that both the time delay was unreasonable and that it was prejudicial to you making your case. The odds aren't particularly in your favor. Why has it taken seven years?
