At the end of our property we have a piece of land that the homeowners association owns. On this piece of property there are 2 trees, one tree is standing and the other tree has split in half with one 1/2 in the water and the other 1/2 leaning over our pool. As a result we cannot use the pool due tot he fact that the tree could fall at any moment. We have asked the Association to have the remaining part of the tree removed but they state that they are not legally responsible for the tree. What is our legal standing?

Yes I agree that we can use the pool if we pay for a tree trimmer, but the tree is beyond needing to be trimmed it is falling down and needs to be removed. The question I need answering is who is legally responsible for the tree? If it is us then fine we will pay to have it removed but if it is the association then surely aren't they responsible for having the tree removed? Also we have not contacted our insurance agent but will do on the next business day.
